WHY
Do we have LAW?
TO ALL Legislators and their Staff,
Please ask yourself this important question for INFORMED CITIZENS:
WHY do we have a Legislative Department of government for our Land of Texas?
Short answer is to make LAW.
But WHY do we have LAW?
LAW is NOT necessary for a STATE to function.
Governments have existed and functioned throughout history WITHOUT law.
Genghis Khan governed an Empire WITHOUT Law, at the same time that LAW, known as the Magna Carta or Great Charter of Liberties, was established as LAW, common to all and binding on the King for the first time in England 800 years ago.
The Roman Republic established LAW 2,500 years ago and flourished with LAW.
The Rule of Law ended shortly before the birth of Jesus, initiating the Christian revolt against the Lawlessness of the Empire. But the Roman Empire continued as government for another 400 years while the lawlessness of THE STATE gradually led to its demise.
The STATES of Europe, known as Kingdoms during the dark ages, functioned without Law. The King and those he Titled as Noble were the STATE and whatever they said ruled the subjects that were de facto slaves. In fact, the word “slave” is derived from the word “slav”, referring to an ethnic group / race enslaved by the lawless system of feudalism for hundreds of years. A system that stifled economic progress.
We have LAW and a LEGISLATURE to make Law, for ONE reason alone;
To PROTECT the Citizen FROM the STATE.
The belief that the STATE makes LAW, through the Legislative Department, to protect the people from each other, is a MYTH. It is not logical. It has no basis in reason.
Our STATE could function WITHOUT a Legislative Department. Our Founders could have created a system with only the Executive Department and the Judicial Department.
It would be a system very much like the Feudal System of the Dark Ages. The Judicial Department would make arbitrary and capricious rulings referred to as “common law” while the Executive under a Governor acting like a King, would Title Nobles for employment in his government to govern the public. Those given the noble title of Judge, by appointment of the Governor, might give a citizen relief from arbitrary punishment inflicted by the Titled Nobles, or not, but always subject to assent of Attorney General.
If the LAW does not PROTECT a Citizen FROM the STATE OF TEXAS, then we have no Citizens. Rather, we have SUBJECTS that are de facto property of the STATE.
The people of Texas then have NO private property, only the appearance or pretence of private property. A Communist State is not much different than a Feudal State. All subjects are owned by the STATE. The only difference is the division of property the subjects are allowed to use, while the STATE chooses to allow it. But ALL property, personal and real, is owned by the STATE subject to being taken at any time.
THE LEGISLATURE HAS DUTY BEYOND MAKING LAW
In past Legislative Sessions; INFORMED CITIZENS have encountered an attitude among Legislators and Staff that is dysfunctional. A belief the only function of the Legislative Department is to make Law and to divvy up the spoils of government among the Three Departments of THE STATE. The LAW is then handed to the Executive and Judicial Departments, with a share of the treasury, with the implicit instruction to abide by the law, or not. It is your choice as Titled Nobles of the Executive & Judiciary.
If the Executive and the Judicial Actors of the STATE disregard the Law, and rule arbitrarily & capriciously (the opposite of Liberty and Justice), that is OK. The Legislature will simply meet again in 2 years and make some changes. But the changes will be as immaterial and irrelevant as the Acts of the Legislature 2 years before.
AGAIN the Law will be IGNORED, and the people of Texas oppressed, the Citizen arbitrarily and capriciously subjected to punishment and unlawful taking of their property, personal & real. If the citizen petitions for redress and remedy they will be told the COURT is CLOSED to them because the STATE is IMMUNE from suit or liability.
With this attitude – we do not need a Legislative Department.
The STATE can function WITHOUT the expense and trouble.
LAW is created to BIND the ACTORS, jointly & severally, in the Executive and the Judicial Departments of the STATE.
The FUNCTION of the Legislature is to act as a CHECK on violations of the Law of our Constitution, and the Law of our Legislature (Statutes) committed by the Executive and the Judicial Departments. If the Legislature refuses or neglects this duty, then we do NOT have a Democracy or a Republican Form of Government.
Our Legislative Department has a DUTY, Legal and Fiduciary, to provide Restitution to the Citizen that has been victimized by the Executive and Judicial Departments, by and through its Actors acting in the name of THE STATE OF TEXAS.
