RE: ERRATA in our TEXAS CONSTITUTION
WANTED, Legislators dedicated to LIBERTY, also known as THE RULE OF LAW.
WANTED, Legislators who know this begins with a CONSTITUTIONAL government.
A Constitution binds the government (aka the STATE), and its actors. It is the supreme Law of the Land. It is the will of the sovereign, the Law of the Sovereign, (the public) telling our government on our land what it must do, and what it may not do. It is a standing injunction with prohibitions and mandates. Without it, we do not have a civil society, but rather anarchy under the pretense of order. Without it, we have no law but only the color of law used to oppress and plunder, rather than to protect and prosper.
INFORMED CITIZENS has discovered errata in our Texas Constitution. [errata: an error in published material]. Our Texas Constitution cannot have any provision that was not approved by the citizens of Texas. Our Texas Constitution cannot have any provision that was not approved by vote of our Legislators prior to presenting an amendment to the citizens for approval. But that is what we have, in section 51-c of article 3.
INFORMED CITIZENS wants to see this corrected in this session of our Legislature.
There is no greater sign of a government has become dysfunctional then a government that has become free to wrongfully imprison its citizens without providing restitution for the wrong. It is a deprivation of private property rights. It deprives the people of the only property given to them by God when they are born. That is, their person and their time.
AUSTIN, our Capital City, is named after a victim of wrongful imprisonment. Obviously, the intent of the Founders of Law for our Land – TEXAS – intended our Texas Constitution to secure the god-given right of the Citizen to have restitution for their private property taken, damaged, and destroyed by a wrongful imprisonment by the STATE. If not, they would not have demanded independence from the State of Mexico.
A provision in our Texas Constitution, the last line of section 51-c of Article 3, has been utilized to deprive the citizens of Texas of their god-given right to have restitution when then have been a victim of a wrongful imprisonment. INFORMED CITIZENS has the records of the 1956 Amendment, certified from the keeper of State Archives.
1 – The provision utilized to deprive the citizens of Texas of their god-given Right to Restitution from the STATE for Wrongfully imprisoning them was REMOVED by Legislative Committee before voted on by the Senate and the House.
2 – The offending provision was NOT submitted to the voters, who approved the amendment. The voters in 1956, with 86.5% in favor of the amendment, obviously intended to provide additional security for the god-given right to restitution for the victim of a wrongful imprisonment.
3 – HOWEVER; the Amendment, as presented to the governor, and later published, put the offending provision back into the Amendment. The result is the OPPOSITE of what the all the Senators and almost all the Representatives, and the citizens in the 1956 vote, intended.
INFORMED CITIZENS is asking for Senators and Representatives to author and sponsor a bill in the 2009 legislature to correct this errata.
INFORMED CITIZENS is also asking for Senators and Representatives to author and sponsor revision of the statutory law intended to provide additional security for the god-given right of the victim of wrongful imprisonment to recovery their property taken, damaged, and destroyed by the STATE, by and through its actors.
As it is, malfeasant actors in the Executive and Judicial Departments of our STATE have utilized the offending, unauthorized, errata provision to deprive the Citizen of Texas of an inherent, inalienable, fundamental, substantive, natural, and god-given RIGHT our Texas Constitution intended in 1836, and again in 1956, to secure.
